The scope, price, payment terms, minimum order quantity, sample terms, tooling or development costs, approval process, production schedule, inspection standards, delivery terms, warranty terms, intellectual property rights, and other conditions for a transaction must be agreed in writing by the parties.

Customer-supplied logos, artwork, product requirements, technical materials, trademarks, and other content must be accurate, lawful, and authorized for use. The customer is responsible for ensuring that its instructions and materials do not infringe the rights of any third party.

Unless otherwise agreed in writing, product samples, prototypes, images, color representations, and pre-production units may differ from final mass-production units within reasonable manufacturing tolerances.

Prices may be affected by product configuration, order quantity, customization, materials, packaging, freight, exchange rates, duties, taxes, and other commercial factors.

An order becomes binding only when accepted by Bowlum in writing or otherwise confirmed under an applicable sales agreement. Customers are responsible for providing complete and accurate shipping, billing, product, packaging, and regulatory information.

Unless a written agreement states otherwise, the customer is responsible for payment of applicable taxes, customs duties, import charges, bank fees, freight costs, and other charges associated with the transaction.

The Bowlum name, logo, branding, website design, text, graphics, photographs, product presentation, layouts, technical materials, and other website content are owned by Bowlum or used with permission and are protected by applicable intellectual property laws.

Except for limited access for legitimate business evaluation, you may not reproduce, modify, publish, transmit, distribute, display, sell, license, create derivative works from, or otherwise exploit Bowlum content without prior written authorization.

Ownership and permitted use of customer-supplied materials, Bowlum-developed designs, custom tooling, product concepts, technical drawings, packaging artwork, and other project deliverables will be determined by the applicable written agreement. No intellectual property rights are transferred through website access alone.
